Is this allowed?
Yes. Florida's former ban on credit card surcharges was held unconstitutional by federal courts and is no longer enforced. Merchants in Florida may add a surcharge to credit card purchases, provided it is clearly disclosed and follows card network rules. How the surcharge works
- Amount: 3% of the transaction total. This does not exceed our cost of processing credit card payments.
- Credit cards only: The surcharge is not applied to debit card or prepaid card transactions.
- Disclosure: The surcharge is shown before you complete your purchase and appears as a separate line on your receipt.
- Avoiding the fee: You can avoid the surcharge by paying with a debit card or another accepted non-credit payment method.
